If the decedent left a valid Will, a petition is filed with the appropriate Probate Court to appoint a Personal Representative and to allow the will. After a one year probate period, creditors are paid and the remaining assets of the estate are distributed to the persons named in the will. If the the decedent did not leave a valid Will, the assets will be distributed according to the laws of intestacy.
